Lease contract

Flight and rental car:
The flights to and rental cars in Florida are not included under the lease contract and must be booked by the client himself.

Booking:
Upon receipt of the booking confirmation by the tenant the payment of a deposit must be effected as lease security within 14 days. With receipt of the deposit as security, the lease contract is accomplished.

Payment:
Approx. 4-6 weeks before the arrival the tenant receives the final invoice. The security deposit will be considered therein. Upon receipt of the final payment, approximately 1 week before departure the tenant will receive the route description of the rental property, the house keys, as well as the address and the phone number at which he can be reached by phone at the rented object.
In addition, the tenant receives the phone number of the person responsible for the property management on-site. (See final cleaning and the taking of care).

Cancellation:
The cancellation of a booked and confirmed reservation is only possible with the payment of a cancellation fee and is graded as follows. The period relates to the period prior to start: until 120 days = 20%, until 60 days = 50%, until 30 days = 80%, until the arrival = 90% (respectively calculated from the total lease price). A travel cancellation insurance is recommended. If the hirer or the tenant who cancelled the lease finds a new, full paying tenant for the same period, the cancellation fee is reduced to 20%.
If the hirer, for superior reasons, is forced to withdraw from the contract, a right of recourse is not justified.

Final Cleaning and taking of care :
Immediately after the end of the stay a final cleaning of the object takes place. Kitchen utensils, crockery, cutlery, glasses etc, and a possibly existing gas grill are not included in the scope of this final cleaning. If the kitchen or barbecue is not properly cleaned by the tenants, the final cleaning will be carried out with a separate fee (at least 50 U.S. $, depending on the time). On arrival, the tenant pays a part of the cost of the final cleaning on-site to the person caring for of the property. (Depending on house size between 100 US $ and 120 US $). At the same time, at the start of the stay the tenant is instructed in the techniques of the house.

Rental object:
is a villa including a pool with the amenities customary in vacation homes. The extensive optional extras are available to the tenants and are also free of charge. The non-existence or a malfunction of the special equipment constitute no impairment of contract. Complaints must be reported immediately on-site to the person taking care. Later announced reclamations cannot be accepted. The furnishing and equipment of the villa is individual according to the taste of the owner. The villa is located in a residential area. Disturbances can therefore possibly be caused by temporary building activities in the neighbourhood.

The liability of the hirer:
The hirer is not liable for majeure risk, disasters of nature, war, civil unrest, supply shortages or other circumstances for which the hirer is not personally responsible . The hirer is liable in an amount limited to the amount of three times of the rent that the villa is in a habitable condition. The liability of the hirer is in any event limited to an amount which is t three times the amount of the rent paid. This limitation of liability is not valid for accidents of any kind resulting in bodily damage caused by gross negligence or intent of the hirer. The hirer is not a travel agency. The travel law therefore does not apply.

The liability of the tenant:
The use of the property and the pool, the villa and all of its equipment is explicitly at the risk of the tenant. If minors are included as part of the inhabitants of the house, the tenant must perform in each case and in full scope its supervisory duty . The tenant, and all persons accompanying him are jointly liable under the terms of the lease contract . For damage and contamination caused by the tenant or by accompanying persons who have visited him during his stay, a relevant compensation must be paid to the hirer. If the deposit is not sufficient to cover the damage, further claims will be made to the tenant. Users have to take care of the house and its furnishing. The tenants are responsible for the cleaning during the stay.
With the conclusion of the lease contract the tenant explicitly acknowledges these lease conditions.

Jurisdiction and Applicable Law:

For full merchants Rosenheim in Upper Bavaria is agreed upon as place of jurisdiction. German law applies.
